RESTRICTIONS ON THE USE OF MATERIALS
The content, organization, design, graphics, and additional materials of Cinereach.org (the “Site” or “Website”) therein incorporated are protected by copyrights, trademarks, and service marks in all forms, media, and technologies existing now and hereinafter developed. The Site is and shall remain the property of Cinereach. Copying, reproducing, appropriating, modifying or publishing of any such part of the Site without the prior written approval of Cinereach is strictly prohibited.
The content provided on the Site is provided for free to users for informational purposes only. No information contained herein creates any relationship between Cinereach and any other party. Users of the Site accept that the content herein is provided on an “as is” basis. Under no circumstances will Cinereach, its subsidiaries, officers, directors, employees, partners, agents and representatives be held liable for any loss or damages caused by a user’s reliance on information obtained through the content on the Site. Additionally, in no event shall Cinereach be liable for any direct, indirect, incidental, special or consequential damages arising out of or relating to the content or service of the Site, whether based on warranty, contract, tort, or any other legal theory. Because some jurisdictions do not allow the exclusion or limitation of liability for negligence, consequential, or incidental damages, in such jurisdictions Cinereach’s liability is limited to the greatest extent permitted by law.
By using the Site you agree to indemnify, defend and hold Cinereach and its subsidiary and affiliated companies and the officers, directors, employees, partners, agents and representatives of the foregoing harmless from any and all liability, loss, damages, claim, and expense, including reasonable attorney’s fees, related to any violation of these Terms or use of its Website and Cinereach Portal.
If you have a project for which you are seeking support from Cinereach, please use our formal online submission process here.
Outside of our formal online submission process, Cinereach does not accept or consider unsolicited materials of any kind, and discards all such materials upon receipt. Accordingly, information obtained from this Website may not be used to submit unsolicited materials to Cinereach via any means. Please do not submit any unsolicited materials in any form to Cinereach or any of its agents or employees.
The purpose of this term of use is to avoid any potential misunderstandings if an original work you send to Cinereach seems similar to a Cinereach supported or produced work, since many works and submissions are based on similar ideas.
Please note, if you choose to disregard this provision and submit unsolicited materials, you acknowledge that you have read this provision and you understand that Cinereach has no obligation to you or to your submission, and that you have no claim whatsoever based on such submission.
All ideas, notes, suggestions, comments, concepts or other information sent by users to Cinereach (collectively referred to as “Suggestions”) shall be deemed and shall remain the sole property of Cinereach and shall not be subject to any obligation of confidentiality on the part of Cinereach. Without limiting the foregoing, Cinereach shall be deemed to own all known and hereafter existing rights of every kind and nature regarding the Suggestions and shall be entitled to unrestricted use of the Suggestions for any purpose, without compensation to the provider of the Suggestions.
These Terms shall be governed by and construed in accordance with the laws of the State of New York (United States), excluding any laws that might direct the application of the laws of another jurisdiction. We may store and process Personal Information on servers or on a cloud located in the United States and elsewhere. Any action relating to the content of the Site or these Terms must be brought in the federal or state courts located in New York, New York, and you hereby irrevocably consent to the jurisdiction of such courts.
